Until I get my copy of the Settlement Agreement - this is the best explanation for all 3 documents.
A permanent injunction is an order prohibiting a person or entity from a specific activity... permanently.
"Stipulated" means that both parties (meaning, the NGF guys and the Playmore guys) agreed to the injunction.
The injunction is against Dion and Chris, it is unilateral.
After Playmore filed the suit, a "settlement conference" was had that reached this agreement.
At that conference, there was a "Settlement and Release Agreement" that has not been produced. Dion and Chris wont produce it.
They say its "Confidential" - a lot of bickering could be ended by them producing it.
So all we have to go with is whats in this order, which is most likely everything that was in this agreement anyway.
This order prohibits Dion and Chris, FOREVER, from selling "unauthorized video game cartridges... AND those games set forth in Exhibit "A""
The problem is, this order was terribly written, it doesnt say what video game cartridges are authorized or unauthorized, or what unauthorized means.
And the way its worded, it could be interpreted to mean that they can't sell any of the games listed in Exhibit A - (i.e. "...AND those games set forth in Exhibit A...")
So it is as clear as mud.

Ok, first off, everything in that release is past tense.
So it is not clear that they are still allowed to sell those games.

Yes, they aren't made by SNK
But, if the game is on that list, I assume they had permission by SNK, since they won't produce the agreement.
But what does "permission" mean....? Dion and Chris want everyone to believe they had some "licenses" or these were "official" releases.
Permission might just mean that Playmore agreed not to sue them for these releases.
Some Japanese guy wrote this... there is no exception in the injunction for a "press release" so if i were Dion and Chris, I would be very careful about selling anything.
Anyone who wants to get the real story should contact the lawyers for Playmore.
For Chris and Dion to say "these are official games" is still as ridiculous as it ever was.
It's like, what if Nintendo made a press release saying that some fan group ("nintendoage") had their "permission" to sell repro Stadium Events carts?
That doesnt make nintendoage's repro carts any less shitty, or the original any less desirable.
Define official.
To a collector, it means from the original company.
NGF stuff is not official no matter how much "permission" or "licenses" they have.
Just because they have a press release that says SNK gave "permission" to sell them.
There are no freaked releases on that list at all. No English Pulstar, or any other "corrected" releases.
