The police are who helped me get the charges dropped from a felony to a misdemeanor.

The other guy was able to press charges on me because I had a gun to his head.

Like I said, it's an upscale, older neighborhood. Lots of great people.

what state do you live in? also wondering how much the bond was? were you on a porch or something. wonder if you actually in your house pointing out would that matter.

neighborhoods with old people are great untill they die and the young douche bags move in then you are screwed specially if you own the house.

I was grabbing my shotgun as he advanced onto my property.

No warning was issued - it happened very quickly.

Freaking this. If you can't even protect your own property when someone crosses that habitual line, then I don't what to say. People these days are too dependent on the law and the cops know this. They use this to their advantage to screw over those that attempt to live a peaceful life and instead support those that do wrong. You did the right thing in book TonK. As the man of the house, you do what you must to protect your wife AND your kid. I bet you anything those cops don't have families of their own. Thank God all mighty no one got shot.

After being humiliated in our local newspaper.

For anyone who talks tough about shooting someone, believe me - they are just bitches.

The tough guy in me disappeared as soon as that barrel was inches from his face.

Worst feeling I've ever had.

If he went for his gun, I may have shot him.

If this was CA you'd definitely be in jail for brandishing, felonious assault w/ a deadly weapon, etc and your life would be ruined. Thankfully you live in a more sensible region.

I'm glad your family is safe, you aren't in jail, and you still have your 2A rights.

Do you have a fence on your front yard?

Get a nice looking white picket fence with a gate and make sure there is no access to the yard from your driveway (except through a gate.) The gate does not have to lock or have a lock. You can generlly have and carry a gun in your front yard in this manner (even in CA!) even if openly carrying a loaded weapon in public is illegal, because in this situation, the gated in area is considered "not accesible" to the public, and therefore not a public space.

Had the dude crossed the threshold of the closed gate (and not left your yard, had you asked) he could have been hit with trespassing, and at a minimum you would have had more leeway with having a loaded gun outside.

It really depends on what kind of Castle Law they have where you live. Even in CA I could legally shoot anyone who broke in to my home, so long as I didn't shoot them while they were clearly fleeing.

Worst case scenario is that the dude could have shot Tonk, killed him, and got off scot free so long as he stated Tonk drew a gun on him first (so long as Tonk actually did point the gun at him first, which he did.)

I'm not saying that's right, but that's how it is.

Reminds me of the problems I had with this one Drug Dealer/Pimp in March of 2007 (I've talked about it here before)
and how it ended up in a Mexican standoff with my father and I and four SAPD Vice cops about to raid the condo 3
doors down (we'd made the call a bit earlier verifying the right place, but they were early), and I can say that what
you describe is accurate about pointing a weapon at a person, plus everything goes into this weird slow motion, and
you feel like you're gonna shit your pants and you can literally hear your damn heart beat in your ears.

I guess the laws are different there though. Here, (and I lived in a condo) as long as I was within so many feet that
was considered an extension of my domicile, I could walk around with a pistol or long gun (loaded) in plain sight and
deter a criminal. As Lagduf put it, I could even engage the said actor with provocation to do so, but not if they
were in the act of fleeing.

I'm in shock that you'd have to go through what you did man. That just doesn't seem right at all. In my case, everyone
realized both sides were the good guys, and I was even allowed to partake in the raid on said drug dealer/pimp (more because
I was recognized for being the guy who had been thwarting the prostitution for a month on my own and that I was a SERAC/S.E.O.
worth his salt)... but that shit you went through is fucked with a capital F. Kind of reminds me of how the citizens in the aftermath
of Hurricane Katrina were disarmed and treated as the enemy by National Guardsmen, when they had a right to defend their homes
and had been doing so from parasitic scum out there (at the time). The laws on the books are not rooted in common sense 9 times out
of 10.

I'm not a gun person at all. At least I wasn't up until a couple weeks ago. I know nothing about guns, but I want to get one for the very situation that happened to you. I'm moving to a bigger city next year and want to have one for home protection, and maybe to take the firing range every so often (learn how to use it/blow off steam). I hope I never get into a situation where I'm forced to bring it out and then have the fucking cops detain me, though. That fucking sucks, dude.

I'm glad you guys feel I was in the right, but it's really been bothering me that this all happened.

The look in that guys eyes is something I'll never forget.

He looked as if the life was snatched right out of him, he knew he fucked with the wrong person.

He thought he was going to die.

I never want to see that look ever again.

After my brother bailed me out, I came home and cried.

I was terrified of what I did.

I'm so grateful I had the self discipline to hold the guy at bay until the police arrived.

Had I not seen a firearm on him, it would have surely ended in a fistfight.

Just hope none of you ever have to deal with this shit.

And it can happen anywhere.

I no longer carry my Glock. I'm almost scared of guns right now.

In situations like these with me I wish the other guy would lay a finger on me, just to give me an excuse to show him how close to death he can be.

Some people just need a good ass beating. A little humility to show they are absolutely nothing but fragile beings. The look Tonk saw in his eyes sound like that sufficed.

First off...I am seriously thankful nothing happened...I'm happy you and your family are safe.

With that said...you got's to know your local laws man. I know here in Illinois, I would be sitting in a cell if I did that. Had he came into my home, that's a different story. I know this is easy to say from my computure desk but had that been me, I would have grabbed my shotgun and then stood inside the door of my home. if he would have come in, it would have been game time. If not...I wouldn't have gone after him. I've sene your case reported many times and damn near every time...the innocent (you) get ass rammed for it. It sucks but its the law.
