I'm sure someone knows a hell of a lot more about it than me and I could be wrong, but I believe helicopters are not usually under ATC, they fly low and relatively slow so they're probably just using VFR.

How Army helis that operate in and around a heavily restricted airspace like DC wouldn't know typical landing approaches at Reagan is beyond my comprehension.

I agree with Sneth, it's a massive fuck up by the helicopter barring something completely unexpected.
