Just got this fabulous e-mail from the guy I sold my Sam Sho V kit to:

Hi I got the game. But it is not a full kit. It has no marquee did it have one? Did you not send it with the game? Or did you not have one for it? if you did not have a marquee for the game you shoud not of said full kit in add. I PAYED 112.00 TO MUCH FOR A UNCOMPLTE KIT. IF YOU DONT HAVE THE MARQUEE I WANT MY MONEY BACK.

I bought said kit brand new from the Neostore, and I included all items that I got with it in the auction. I also had all items pictured in the auction, thus he knew exactly what he was getting. Here's the finished auction: http://cgi.ebay.com/ws/eBayISAPI.dll?ViewItem&ih=010&sspagename=STRK%3AMESO%3AIT&viewitem=&item=200053176767&rd=1&rd=1

Is there a full-sized marquee for this? As I said, I sent him all I ever had, and I doubt Shawn would have sold me an incomplete kit.

I'm willing to do the refund if there actually is a marquee, but he'd have to send the whole thing back to me first.

HE IS PRETTY SERIOUS USING CAPS JRO I'D WATCH OUT

I was bidding on that kit, if you end up refunding/relisting let me know. He bought what was pictured so I highly highly doubt he would win a dispute against you.

You either have a complete kit with the large marquee or a complete MVS kit without the large marquee. Most MVS games were released with a large marquee but SNK USA often ran out of the large marquees or had them but didn’t always ship them to distributors.

Acquiring large marquees is almost on par with acquiring the matching poster. Is your MVS kit complete without the poster? Most would say yes, as would I. The same concept typically applies when a large marquee is concerned. For instance, if you have a Twinkle Star Sprites MVS kit with absolutely everything it was originally released with inside the box but lack the large marquee and the TSS poster, most would agree that you would still have a complete MVS kit.

As long as you never mentioned a large marquee or full size poster in the item description, or displayed a picture of a large marquee or poster in your auction, you should not be obligated to provide a large marquee or poster to the buyer.

Many thanks for the responses. I'm about to e-mail him back that I won't be offering a refund, and I'll even invite him to read this thread if he wants more information.

Tell the duder you can get the marquee and it's poster but @ cost.

Remind again of the item description.

Job done.

Actually, now I'm having second thoughts- the money really isn't a big deal, and I'm sure I could turn around and sell it for near the same price to someone else.

I'm really not into the idea of taking a chance on a PP claim, given the horror stories.

Rather than play PayPal roulette, I went ahead and told him I'd refund his money upon my receipt of the kit in the same condition that I sent it out in (as in mint).

I figure that my initial willingness to bend over backwards should help if he files a claim.

Dub, you still want it? Assuming I get the kit back from this guy I would love to avoid going back to eBay for a while.

Screw that man. You didn't have the marquee pictured in your photo, therefore it wasn't implied taht it comes with one.

Games like NiTD, Metal Slug and King of Fighters all have large marquees, but its not expected that they are included in the full kits...

His fault for bidding without inspecting the goods better, simple as that.

He could very well be speaking about the mini-marquee that arcadeshock did. I wouldn't say a complete kit needs it because not every kit has one, but I could see how he thinks it's incomplete. It's not pictured though, so any responsible buyer should ask, especially in such a special case. All I would offer him is a "sorry, but there's nothing I can do."

Just as a means of tying up loose ends to the story, dude got a bit weird. I sent him an e-mail explaining very clearly that the large marquee is rarely included, that I didn't picture or mention it, thus I wasn't obligated to include it, but that I still would be willing to send a refund.

So then he e-mails me back and says oh, no, I meant the mini-marquee. I run an arcade, I know what I'm talking about ( :spock: ), that's the one I wanted.

So, growing impatient with his changing stories and just wanting to not deal with this guy any more, I e-mail him back that look, I sent everything that came with it, if you don't like it send it back and I'll give you a refund.

So then he e-mails me one last time with oh, sorry, I'm perfectly happy with it, I just wanted a marquee, I'll just find one on my own.

Um-hmm.
