Dude how are you going to tell me the stickers were peeled back???? You didn't even see the damn cart! It was in my posetion and Steve's. I pay very very close attention to details, you can't possibly tell me they weren't cut before they got to me because that is a LIE.

Regardless, I've shipped over 15 different CPS3 cartridges in the past 7 months, I always pack well, and ship in anti static bags. NOT ONE HAS BEEN DOA. So this "cheesey excuse" seems to hold weight in my book, and I specificly requested.

I've had one deal turn out like this - we split the costs 50/50. That seems like the fair thing to do here.

But truthfully and in general, when you're buying used goods, and not specifically asking for insurance, once it's out of the seller's home, it's the buyer's responsibility, no matter what happens to it.

Sad to see stuff like this happen on the boards, especially between two people with lots of deals done.

Tonk, what would you do if you bought a used, "tested and working" original Metal Slug 1 for $1200, and it arrived completely DEAD. Would honestly settle for 1/2 of your money back? That is just obsurd!

I have been following (and posting in) this dispute since it happened. Only two people know the condition of the stickers and that is the seller and buyer, so I don't see how anyone else can comment on that.

I also don't see how the buyer did anything shady here. I don't see this deal ever getting better than a 50/50 split, so that is probably what should happen.

Like many others, I don't get involved in these types of conversations, but I just had to throw my two cents in.

Really all it adds up to is that bill didn't pay for insurance, period. Yea it sucks and it's not fair for either party, but assuming insurance should have been included after the fact is not fair to Spike. As far as the static wrap goes, in my experience, it's not anything that great. Sure it does give minimal protection, but when you're talking about shipping packages like that, a whole number of things could have happened that have nothing to do with the anti-static wrap. I honestly don't think it would have made any difference, but hey, that's just what I think. I've shipped off many high ticket items without insurance because the buyer didn't want to have to pay extra, and that's his choice.

I agree that the board should be sent to a third party to get a better idea of what is wrong with the game and if it can be fixed. This sucks either way, but I guess it's a lesson both ways.

Bill thinks he is entitled to 75% of the purchase price because of the anti-static error...

Would you settle for 50% back if you dropped $1200 on a "working" AES Metal Slug 1 and it came DOA?

If I feel that I paid out of my ass for something, you better believe it would be insured...

I am sorry but does anyone think that the post office is really going to pay out $400 plus on a claim when their was no damage to the box? If it was that easy, people would send broken shit to each other all of the time and collect.

Are we saying that if insurance was put on the cart and the post office didn't pay, the seller would then be out 100% of the money?

You guys really just need to do a 50/50 split and move on. You are both losing out on this deal and it is never going to get any better.

It was already established that if the box is undamaged, an insurance claim will not be granted. Insurance is not a factor in this dispute.

It was already established in this thread by an actual employee of the US postal service that it'll still be granted.

Either 50/50, or Spike should just take the negative and refuse to refund. Next time, buy insurance for a high $ item.

Here's the thing bill, you have to understand the risks that are taken when an item is shipped. Even if it was insured, from what I'm hearing, it doesn't look like you would get much help from them either. Add to that the amount of money you're asking for is a bit much. In legality, Spike is entitled to ALL the money if the cart is returned back to him. I mean, if we're going to get legalistic, Spike wins it hands down. Is it fair, hell no, but as far as the law goes, you don't have a leg to stand on. It's nothing personal, it's just life.

I'm also with TonK, that anti-static bag wouldn't have done a thing.

Phillip is a great guy and I have dealt with him several times. He really only had the one example though.

Like I stated, if it was that easy to get a claim approved on a box with no damage, people would send broken shit to each other to get their money back. These two guys could do it now and I can assure you they would not get the claimed approved without damage to the box.

Also...anyone that has dealt with the post office trying to get money back (overnight delivery that doesn't make it on time) knows how hard and how long it takes to maybe get your money back. (And that is just for $20)
