Straitfromjapan / Tina May - Nasty ebay situation

OK. Before I start, everything I am about to say is FACT and I can supply EVIDENCE of all of it in case the seller in question sees this and gets any more bright ideas.
I must also point out that at least one other board member has dealt with this seller and (as far as I’m aware), are fully satisfied. I must also point out that until I checked my inbox this morning I had no intention of posting a thread like this as I had received a full refund and polite communication to go with it.

On Oct 17th I purchased eBay item 3053830462, a Japanese Flying Power Disc NGH described as
“This is a new game, never inserted or used. Manual is in plastic.”. I also double checked the condition with the seller when I emailed them for payment info and got the response “Yep, new is new. I know where you're coming from on that. No worries, it is sweet”.
When I received the game on 23rd, it was not as described. It had obviously been used. The box and manual were around the “Very Good” mark and the cart had heavy scratches and was in Gamers condition. I emailed the seller and got the response
“Wow, yeah I checked the cart out myself and I did think it was in great condition. It was sold to us as new as well. If you arent happy of course we will refund you and accept a return on that. We obviously didnt mean to mislead you“
Naturally, I was happy with this and sent the game off on 24th. The seller had also promised to refund the return shipping so all was well.
Item was confirmed delivered on 27th and I didn’t hear anything so on Nov 2nd I sent a payment request with a note. In response I got an email “Hi, I havent forgot the refund, Im just awaiting our p-pal funds to build back up as eBay took out fees 2 days ago and basically cleaned us out. Dont worry, it doesnt take long to build back up”
Not ideal, but understandable. I was happy just to get my refund. Another week went by so I sent a payment reminder and finally, on 10th Nov I got my refund. Almost a month wasted but these things happen and I was just happy I wasn’t out of pocket.

Until today I was perfectly happy to leave it at that and simply avoid their auctions in future. Obviously just another ebay seller who can’t grade a cart.

Yesterday I left a thoroughly deserved neutral and what do I get in my inbox today?:

Yes guys and gals, the lovely Tina and co are claiming that payment they/she made was for a purchase, not a refund and that purchase hasn’t arrived. Tina is pissed that I left a neutral and is now trying to scam me out of the $190! There is a pending payment in my account, to her, which will go through unless I can prove I’ve sent the item (which she hasn’t bought) or I can prove I’ve refunded her another way or I have proof of posting this item.
Luckily, I have the tracking number of the return and hopefully that and a polite email to Paypal will get this sorted. It’s my own stupid fault for going about the refund in the incorrect way but her emails seemed so polite and understanding.
As I said before, I’d be willing to let this drop. Tina May and friends obviously don’t know what they’re doing but as long as I had my refund, I’d be happy but now Straitfromjapan are trying to STEAL MY MONEY. Plain and simple and for that I think the Neo community need to be warned.

UPDATE 8th Dec - in case anyone digs this up.
Thought i'd edit this post with an update rather than bump the topic and give straitfromjapan more bad vibes as it appears this is all down to one person, Tina May. I now have my money back, not because they cancelled the claim however, but because Paypal saw sense after I contacted them. I did have good contact from the other bloke that emailed me but it fizzled out when I refused to let the claim (calling ME a thief) go through and accept a $20 lighter refund because they have a new policy on refunding shipping. The cheek!
Anyway, i've got my money so that's that. Oh and they reckon they're going to stop selling Neo stuff now because we're all too fussy so it sounds like i'm not the first to complain. I see by their feedback that someone was less than happy with a new SSIV. They're lucky they didn't leave a neutral and get this shit tbh ;)

Have you tried e-mailing them to see what it was all about?

In all honesty I would have left a positive but a neutral doesn't warrant this type of action.

Perhaps there is more than one person that accesses that PayPal account and one doesn't know about the refund?

I would e-mail them and ask whats going on before you call them a scammer. They did refund the money and you did get the game to start out with.

Scammers would have just kept the money and never sent an item from the start.

The fact is, someone has read my feedback, got pissed off and realized that because my refund was through a 'Goods' payment, they can claim it back by saying it was payment for goods I sold them. They have gone through the Paypal complaints system and my balance now reads -$180. Is that not as bad as keeping my money in the first place?
I must admit, I was really surprised they did this after they were so understanding in the first place.

As an update, I have received an email from someone from the Japanese side of the business asking what happened. It appears that as suggested, this could be more down to one person than the Straitfromjapan business as a whole. This guy who emailed me seems like a nice bloke and I hope we sort it out. I'll update this thread whatever happens.

Cooler heads prevail in these situations, just try to communicate with them before calling them scammers. :D

OK. Scammer does imply their sales are a scam I guess so i've altered the topic title but the fact remains someone at straitfromjapan is trying to screw me over for $190. This is not a simple mistake by someone, this is deliberate and these situations with Neo sellers are worth a mention. I think I have been calm about this and i've stated they're not all bad but I believe experiences like this should be made known to "The community" when large ammounts of money are involved. If this is resolved i'll update.

I have recently bought a jap MS3 from them and it arrived as described and very fast so I,personally am happy with their service.

But as you had mentioned earlier there may be a micommunication error on their part.I think they run their auctions from both Japan and the US so it could be a case of the left hand doesnt know what the right hand is doing and that is what has happened.

Personally I myself wouldn't have left a neutral especially as it seems that the refund was done.I would have made sure that I had the money first,possibly transfering it or using it before posting any feedback.

Getting bad feedback/neutral is a pain especially if you have tried to sort things out.My only -f/back on ebay is when I bought a snes,deck only from the US.The item was about $15 and the nob I was dealing with at first said P&P would be $20.Then after paying that I asked if it was covered,he said no and that to get the best cover it would cost $35 to be fully covered and get the 7 day shipping.2 months later and several emails later I had heard nothing.In all I must have sent about 20 emails and had no reply.Then out of the blue I had a mail saying it had been sent and he hadnt responded to my mails as he had been on a rock climbing holiday(for 2 months?!?How slow does he climb?).He couldnt give me any postage details and so I was well pissed off,down $50(about £35) with no snes to show for it.I couldnt claim any money back from ebay as the item itself was less than £20 and you can't claim for postage.I was so pissed that I gave himn some nasty f/back.I was incandescent when the cheeky minging twat gave me bad feedback too........and I was the injured party.Ebay said they couldnt remove the feedback unless I went to a lawyer and get some kind of defamation against this rip-off merchant.What a waste of time eh?

Anyway m8,I hope you get your problem sorted soon and you get all your dosh back.

I did have the money back and I had actually spent it but they decided to claim it was an item I sold to them which they hadn't received and thanks to Paypals protection program they can claim it back off my credit card without my say-so if I can't prove i've sent this item I sold! :mad:

Thanks for the offer but i'm confident it'll get sorted now. I've got the guy from Japan looking into it (seems to be the boss) so hopefully someone will cancel the reversal and if Paypal bother to read the email I sent they should reject it anyway, if they've got any sense. Thank god I kept the return tracking number.
Problem is I can't pay for anything through Paypal without settling the negative balance so it better get sorted soon :mad:

i can see where your coming from, they didn't rate the goods propaly thus you were in your rights to ask for a refund, it seems quite unfair that this has happened, i mean you only left a neutral whats wrong with that?, many people would of got pissed off and probably left a negative claiming they lied about the condition, i don't think there claim would go anywhere, it must be a misunderstanding somewhere.i hope that they drop the claim and leave it at that.
