Macck definitely owes him a refund.... but it seems like the issue here is who pays shipping costs. Is there any rule regarding that?
Yes. If the seller entered into the agreement fraudulently or with the intent to deceive then the seller is responsible for *all* costs.
If this was sold on ebay.br, and boots are not allowed, then circumventing the listing rules to get it sold doesn't make the sale allowed in the first place. Even so, the information could have been disclosed after the end of the auction and before payment was sent. The seller is completely in the wrong.
Furthermore, since ebay has a paper trail of this auction as it was removed twice for listing infractions their customer service and fraud prevention department would clearly side with the buyer. There's no reason to stop at the money. Metalizer may as well get the seller's auction identity banned by contacting ebay with the information about the product coupled with the information that the item was previously removed. Ebay and its users would like this ban to maintain the integrity of the site.
