Police brutality Bobak advice!

Last night my brother was on his way to work, there was a high speed chase going that way. It was a red sports car they were chasing. One cop directed my brother in his WHITE ALERO to pull over to avoid getting in the mess.

After he pulled over a cop came out of nowhere with his gun drawn, yelling for my brother to get out. When my brother got out the cop punched him once and then kicked him. Handcuffed my brother then kicked him one more time because he thought my brother was the perp.

Today my brother went to file a report with the sherrif's dept and they threatened him to not push this matter any further and told him they were destroying the tape.

Without this evidence my brother has no case against the county, what can we do?

they legally have no right to destroy the tape. you can take them to court and they will be required to produce this tape. Also if there was any bruising or anything he should go to a doctor and get pictures taken and a report.

get a doctors report and try filing with a different police station.

I know this is highly unlikely but what about people passing by did he see any other cars around? Does your brother have bruises? What about the cops names? Have him write it all down and press the matter and tell whoever that the police said they were/are going to destroy the tape. That is just wrong the police are supposed to protect people not batter them because they THOUGHT he was the perp. Dont let him leave it because they are going to destroy the tape and make sure he has a good advice peson he can go to. If he has bruises take pictures of them. I hope it helps if only a little I am sorry to hear he is going through that kind of thing.

I know this may be really horrible but if the cop backs him up but wont help you should say that he has seen the tape. Dont let some stupid cop get one over this sort of thing isnt right. Take pictures of the shirt if you havent already.

The road was a small Mississippi back road that I doubt anyone was on but I havent heard much from him yet, he's been at the doctors and the sherrif's department to file a report.

Luckily my brother works for a casino and they are trying to help him as much as they can with this case, they paid for his emergency room visit last night and paid him to take the next few days off.

You won't break the chain of command. Every cop I know (and I know a lot, I work with them in municipal gov't every day) would sooner lie than go against someone higher up in the chain of command. It's unfortunate, but you won't get anywhere by just saying "but he saw it!"

If higher ups are at risk, their subordinates will fall in line as instructed. No way around it. I can tell you that from experience.

No, cops are worse. The very nature of the job tends to attract a macho mentality, and very often the cops are just as bad as the criminals. Many are on steroids, and only on the police force for the power and the thrill, and really don't have the brains to do effective police work.

Back in the early 90's, there was a huge scandal involving the New Orleans police department. Nearly the entire department was involved in drugs, and quite a few were involved in murder. One woman who went against them, and filed a complaint, was actually murdered within days - that's what it took for the FBI to come in and clean house. They actually made a very disturbing episode of the show City Confidential (A & E) about the whole thing.

I've never been one to side with pop culture, but a lot of cops do fit the stereotype. Lots of cops are jerks, and many of them are dangerous and abusive.

Decepticon, tell your brother to get a lawyer and a medical report, ASAP. Also, he should see a pyschologist or a psychiatrist, and this kind of thing is often very damaging psychologically. The testimony of the psychologist could be used in court.

This is fucking insane that a gungho cop and just grab and beat anyone he wishes because they are chasing someone else.

I told him to keep calling around, it was internal affairs who threatened my brother this morning when he went to file a complaint.

It looks like the lawyers down there are scared to get involved.

Yea and when he did internal affairs threatened him for filing a "false" report

My brother originally thought he was kicked twice and so he put that in the report, they said the cop only kicked him once and so the report is a lie.

If you have a gun pointed at your head and just got punched, thrown to the ground and kicked, when the cop puts his kneed into your back to handcuff you, the last thing on your mind was "how many kicks was that?"

One kick or two is a sign of emotional and psychological distress. Get on yellowpages.com and find a laywer from way off.

lol, wouldn't suprise me with the cops around there. I am so glad I am from Gulfport, where the cops are down to earth and cool with just about everybody with the exception of that one high ranking cop who was very well known, very well liked and he got charged with molesting his granddaughter.....OWNED.

BTW where was it you had your "incident" a while back where you were pulled over for no reason at all.

Your brother would be better served if he just left it alone and be thankful he walked away with his life... If he pursues the matter he will be possibly stalked and harassed daily.
If the East is supposed to have a more civilized brand of cop with several recent cases of brutality and one kill while the suspect was handcuffed (They say CPR) in this area,I can just imagine what they do down there.

You pretty much concurr with an attorney I know who refused to help my brother out, he is scared to go into South Mississippi to take on any case against police.

This isn't the 1960's anymore I think it's bullshit that things like this are still allowed.

It was in Biloxi, Mississippi I had just graduated techschool in texas and came back to misssippi on vacation and I left that lame ass club Studio 90 and went to the gas station and picked up some booze and on the way back home I had forgotten to turn on my lights(it was so well lit outside) and 2 cops pulled me over. They had asked if I was drinking or whatever and I told them no and offered to do a breathalizer if they didn't believe me and they refused me and they just searched the living hell out of my car instead. I was like WTF. Maybe they thought I was a drug dealer.

It happened again here in Germany on the Air Base too but this time it was more like Racial profiling than when I was in Biloxi. The stopped me and my buddies (ironically after coming back from the club again and the 2 guys in the car with me had just graduated Techschool in guess where, Biloxi, Mississippi). Anyway, he stopped me and told me my back light wasn't working and then he asked us Why we didn't have any chicks in the car and we told him that "we were good guys, we didn't need no club ho's"(german girls and black american guys go together like Sugar and Kool Aid) so he kept asking us dumb questions and my friend reached for his water bottle to get a drink and the cops completely lost it and started yelling at us and told him to be still and don't move and giving us problems and we talked to them nicely and tried to shoot the shit with em. crazy shit.

Go to a lawyer immediately. Even if this is half true you should go after them.

Tell your brother to go talk to the biggest personal injury firm in the area you're in (they way personal injury firms work is the best firms often get enough business that they only take more sure-fire winners and then let the lesser cases trickle down to other firms). Don't just take this to the corner lawyer with a shingle in the window. If this case is serious, I would take it to a bigger firm with a Personal Injury department.

You should be able to get representation based on contingency: which means you pay only if you win. Criminal charges won't get you a windfall since it's the state's lawyer (but you don't need to pay them either).

Those lawyers are local lawyers who are too afraid, despicable. That's why I mention you need to find the big firms in whatever major city you're near (New Orleans would be a good bet, or Baton Rouge) -they're far more fearless and will assess the realistic possibility. You need to find out what the big personal injury firms are and go talk to them.

The complicating factor is the police were amidst a high speed chase, but that's no excuse for the version of the facts you reported.

Don't just use an internet search, they're too easily manipulated by inferior firms. I'll see if I can't dig up a starting point.

Okay Decepticon, (boy that sounds funny)

It was a little tricky looking for a starting point (your state is the odd one out of the 50 states because it has eccentricites arising from its time as a French colony with French Civil Law), so I went ahead and used "the" lawyer directory (Martindale-Hubbell) and found the biggest firms in New Orleans (because I have no clue where you live) that appear to cover your brother's kind of Civil Rights/Personal Injury claim (its a hybrid). The problem was most of the law firms in LA don't work for your brother's side of these cases. In fact, barely any of them dealt with any of this. However, I did find one very promising start. Here's my strategy for you:

• Have your brother call this firm. They'll do a "client intake" where someone (maybe a paralegal) will take down your brother's information and basic story. He/She will tell your brother a lawyer will call him back.
• The lawyer will review your brother's info, brush up on the relevant law if necessary (probably not in this case) and call him within a reasonable time. He may ask him to come in person, or not (probably not this first time). After discussing the matter with him, the attorney will let him know if the firm will be willing to take the case.
• Here's the trick: If not, the lawyer will let your brother know. However, your brother should feel free to ask the attorney for a suggestion of what other lawyer might. Lawyers are fine with this question, especially bigger firms. That lawyer will tell your brother the name of the other attorney/firm to try (maybe because they specialize in this sort of thing).
• Remember: it's highly unlikely your brother will have to pay for any of this out of pocket. Just remember to clarify the whole "pay on contingency" thing. The lawyers will know exactly what you mean.

My brother hasn't given up yet, he's still contacting attorneys in New Orleans, Baton Rouge, and Mobile to find someone who will take this case.

A friend of mine is an ambulance chaser and said he would love to take the case but is a Louisiana only attorney.

I was going to say get the press to publish something. Your not only going to get public outcry but with public outcry comes lawyers wanting to capitalize on a potential case that could put them in there 15 mins of fame.

I'd consider dinking around Martindale-Hubbell (www.martindale.com) and seeing what you find for firms of all sizes.

It was my bad for not noticing the Mississippi thing about 20 posts down.

Unless your brother is low income (including a student) he could try the legal Aid societies or others.

My brother found an attorney in Hattiesburg who is willing to take his case, I just found out after the guy whipped his ass then found out he had the wrong person he just walked off. Another cop took the handcuffs off of him as my brother was squirming to get up and they just left...no I'm sorry or here let me help you up they just left.

Oh it's bad ... it's real bad. A couple of years ago, an attorney was pulled over on a routine traffic violation, and the cop accused him of being drunk. The lawyer started to tell him that he wasn't, and that he was willing to take a breathalyzer or whatever, and the cop just began to beat him mercilessly.

From what I understand, he of course pressed charges but none of the policemen were ever convicted. I'm pretty sure the judge was in on the good old boy system.

Anyway, I'm never one to bash my home (the South), but that case was absolutely disgraceful. I hope that the outcome will be different in Decepticon's brother's case, but knowing how things work with the police departments down there, I'm cautiously optimistic at best.
