I hate misleading auctions. I once bought a games of this guy I thought was in near mint condition (the description said "great condition" and the pic -a genuine photo not a stock picture- looked great). It arrived in average condition (not like in the pic), and I emailed the seller about it and he replied saying "where in the auction description does it say the item is the same as in the picture?". My reply? "CUNT". Ok, it wasn't much money so I didn't really lose out, but still, I thought it was very misleading.
Very misleading my ass. You got scammed. "where in the auction description does it say the item is the same as in the picture?" dosn't cut it.
If it said "this item in the picture is in SIMILAR condition to the item for sale in the action", wouldn't pass the sniff test either.
If it said "this item in the picture is similar to the item you are bidding on, but the item you are biding may be of equal or lesser quality", and list the
actual quality in the discription, then it would be kosher.
Unfortunately, the example you gave is a classic case of fraud. It's called "the bait-and-switch." You bid on and paid money for a "near-mint" item, what you got was an "avarage" item. He clearly sent you something that wasn't in the auction discription. Therefore: scam.
(sadly, ebay being the way it is now, makes a terrific breeding ground for these ass parasites)
