(3) Computer programs and video games distributed in formats that have become obsolete and which require the original media or hardware as a condition of access. A format shall be considered obsolete if the machine or system necessary to render perceptible a work stored in that format is no longer manufactured or is no longer reasonably available in the commercial marketplace.


This is just an interpretation of the present law but it is quite interesting.

Now we need an interpretation of what they see is reasonable in the common marketplace.

commercial marketplace is basically retail.

ebay is a "gray market," not a commercial market, unless the manufacturer uses ebay as his sole method of distribution.

Thats what I was thinking but they can consider eBay if there are a good number of said consoles up for grabs for a reasonable price.

I think that auctions are clearly gray market. No matter how many are sold there. Commercial would mean that retailers are still stocking them in inventory. Ebay doesn't run on inventory, and ebay sales, more often than not, aren't claimed at tax time. So I would be very careful about calling it commercial.

Then that would make even the SVC and SSV roms legal.

not SVC. You see, the svc rom is on a dedicated pcb.

SS0 though, I don't know. It could be that they still still mvs kits...

I don't think it matters if the copyright is still sold on available hardware.

That would be like copying beta movies onto dvd and distributing them when they can be had on DVD already - still illegal.

Ok but I still don't see the point in playing a 320*240 resolution game on a 1024*786 screen.

I think emulation goes down a lot easier if people stop trying to justify what they are doing and just play the damn roms. If it is something you want, you will pay for it. Truth is, most rom users don't give a shit about the games. Actually, it is the opposite, they care about the roms. There is such a bragging right and collector sickness that is involved in roms and warez in general.

How many romz kids have the whole mame set? How many of them have mastered iRobot or Psycho Soldier (yes, I know I wrote IRobot wrong, I am having an Apple day)? Anyway, my point is, they don't play the games. They just "gotta catch them all" Sample them for 30 mins, if that, and never play them again.

I have a good friend who has a mame cabinet, I've played a few rounds of games on there with him... He fires up a game, we play it for 10 minutes, he gets bored and goes onto something else. I could play TMNT all night, but he just wants to swap to whatever is cool and new. He likes to brag he has all the Neo roms on his machine. Then I play him at MOTW and destroy him. HE doesn't play them, just likes to brag he has them...

I don't know what my point is... so don't ask. I guess I just feel that the majority of rom users are looking for validity in owning the roms, but never care to play them anyway. IF thats the case, just del them all and be done with it ;)

Alot of rom usuers do try and justify owning them and I used to be one but now the only time is when I hear alot about a game and get curious as to if I will like it or not.

That's how I found The Last Blade, MOTW, Kizuna, and Shock Troopers...hell I didn't even know they made a Samurai Shodown past 2 until I got into MAME and now I play them on my AES unless I want to play someone online.

It doesn't even take an anti-rom crusader to argue against those that try to justify using roms. It's simply illogical, and anyone who sees that statement and knows better will argue against it. As nruva said, if you just play the games and not try to justify it, then everything is cool.
