OMFG ! Rom related question

Just a quick question , please don't flame me.

If a Video game company folds , and nobody wants to take over the IP's , Would the roms become Public Domain ? It's a question that's been bugging me for a while now.

Someone could still sue over it if they felt like it.

Well now... If no one buys the IPs, which is unlikely, but I guess could happen, then yes, it would be public as long as no one is looking to sell or buy the IPs... That really is highely unlikely, since when a company folds, usually they will sell of the IPs cheap to make back some money atleast.
