Well,

After about 6 consecutive Phantom1 auctions, ebay decided to pull my newest one.

Has anyone else had this problem? I want to post another one, but ebay threatened to suspend my account

WTF? Ebay would have never done such a thing a few years back but this is typical of cute babies growing up to be big ugly monsters
And they allow the mvs bootlegger morons to continue doing business.. annoyed

Selling bootleg anime by the palleteload on ebay is totally cool, but selling convertors? Now THAT is a crime!

Someone here probably reported you to safe harbor and claimed that the phantoms are illegal. Could be a personal grudge, or just someone wanting to suck playmore's ass. Whoever that was, I know you're reading this, back off the people selling phantoms, if anything, they encourage people to buy legit carts, go after people selling roms cds and shit like that.

What exactly is their stance? There's a shitload of illegal crap on ebay; why single out the Phantom?

Someone should explain how it's not an illegal product. Well other than the fact that the artwork for the boxes and stuff is all used illegally. But the device itself is PERFECTLY legal.

I'm sure SNK Playmore is rather unhappy about the existance of such a device but that doesn't mean it's illegal. Even if a SAC cart was needed to make it, once you buy that SAC cart you can use it in any way you want so long as you don't violate any copyrights.

Only thing that's copywritten on that device is the artwork for the box.

It's bullshit. Ebay allows people to see EverAnime and SonMay bootleg CDs, as well as bootleg anime and bootleg movies (any movie with chinese subtitles that isn't a chinese movie is a boot as far as I am concerned).

Well... the device itself contains a decrypt chip from a cartridge, that is a piece of SNK technology that has been retrofitted into their converter. I am pretty sure SNK has strict rules about disassemblying and re-engineering with that chip...

So, Phantom1s are not ok, but selling ROMs, CD-Rs of illegal programs, music, and other various bootlegs is totally ok?

This is why I stay away from eGay, since the useless fucks that run it apparently can't get their heads out of their asses long enough to properly police auctions. If they're going to crack down on bootlegs, fine, but be consistent, otherwise someone should nail them for supporting illegal activites and discrimination.

Nope. It's the same chip that has (itself) been un-modified. !Arcade! just took it and implamented it in another circuit for which it was not intended. But once you OWN that chip buy purchasing a cart it's yours to do with as you please. You could use it to play the original game, or you could use it to decrypt a different set of ROMS that came from a MVS cart you own that you've put in that circuit if the game was used for a conversion.

Remember the only thing that's actually IP theft in a conversion is the fact that you're using copyrighted artwork for the insert and sticker. If they simply sold converts in a blank Snap-Lock with a blank cartridge that simply had the name of the game written on it, it wouldn't be illegal. All parts were purchased legitimately and were simply dissasembled and re-assembled to fit another purpose. All intellectual property involved with the actual GAME would not be illigally copied or modified in any way.

They might try and take you to court over it, but they would most certainly loose as long as you didn't copy/reprint any artwork that they had copyrights on.

You can't use someone elses product in yours... There are laws against that. That is why there are million dollar product licensing deals, you can't just take someone elses product and repackage it as something else and sell it... it doesn't work like that! The technology has to be licensed from SNK/Playmore in order to be legal... Bobak, or someone knowledgable in trade law... am I wrong about this? This is what I have always been taught!

You're allowed to re-sell a used product. That's how you get used games sold. When you buy the game you own a physical cart and a physical circuit. You can do with that individual circuit as much as you'd like. If you want to take that chip out and put it somewhere else to be used for something else then that's fine.

It's like w/ some high end PC parts (mainly videocards back in the day) where it would only be available in OEM format so you could only buy it as part of say a Compaq computer. Well people would buy that Compaq computer with that part in it, take the part out replace it with something comparible and then sell the part separately from the main computer.

It's perfectly legal to do as far as I know.

It's like saying you can't take a chip out of an old game/motherboard/etc and use it to make a keychain with (ever see those keychains that are made of a 486 Processor with the pins taken off?). It's YOUR chip now you can use it for whatever purpose you want.
