While the case is still in pre-trial motions (which means the main case hasn't begun yet), a very interesting little tidbit has come to light:

Playmore, in amending their initial complaint, has dropped NGF as a defendant and replaced it with Dion Dakis and Chris Ray.

I guess the Playmore attorney's caught onto the fact that NGF is a joke and that it's really the dynamic duo.

Here is the quote from the official court docket:
"3/12/03 41 FIRST AMENDED COMPLAINT [1-1] by plaintiffs Playmore Corporation, SNK Neogeo USA Corp; terminating defendant Neogeo Freak; adding defendants Dion Dakis, Chris Ray; jury demand. Summons not issued (mt) [Entry date 03/19/03]"

I think Jail time it completely out of the question. Financial ruin is more likely, though I think it will more likely be a serious kick to the pants that will teach them a lesson (i.e. never deal in the Neo again). Either way, it benefits the entire Neo Community.

NGF was registered by Dion, so it let Chris away scott-free. It now looks like Playmore's attorneys caught onto that fact (probably from tip-offs from the Neo Community) and then altered their case to include the two actual culprits.

your right just Penalties.

However interesting note. I recall reading up on the Aruze/Playmore law suit and with the loss of the Civil case, Playmore then opened a Criminal Case against Aruze.

what I am wondering

1. Now that it list them as indivduals I am assuming that means they cannot claim NGF bankrupt to aviod paying fines and would mean they would have to claim personal Bankrupcy.

2. Did they also do a raid on Chris's house for Illeagal Merchandise?

3. Assuming Dion is registered with NGF and Chris is not listed as a member of NGF. Also assuming some how Dion had rights to certain things. I would also assume some things Dion may have had the rights to do, Chris did not. Therefore causing him more open to fines. Assuming of course

some things to think about. Maybe it is time to write another thank you letter to the law firm wink

I wonder if NGF is even set up as a real corporation. This would explain why Playmore is going after the individuals and not the company. If it isn't set up as a real company (in other words, if it isn't incorporated as such) they could be in REAL trouble, because the state attorney general will investigate for back taxes. This of course leads to the obvious line:
