In need of some legal aid

OK... I need a simple answer. This guy has a game and memory card of mine's since late January. After weeks and weeks of endless excuses, he told me he finally sent them BACK to me last week.

I do expect the items to come back, but my question is this. With GamerAbyss's Video Game Fraud FAQ, do I have the right to charge him if my items came back in poor condition? (It was sent to him in excellent condition)

Note. This was originally a trade for two games. But after some chatting, I got pissed and said, "Look, you haven't sent me your items and you say you aren't satistified with mine, so how about you just send mine's back and we'll move on."

The good thing on my side is that this punk has screwed with 7 other people. So if I take this to his hometown police like GA's FAQ states, I will have 7 other people across the US to plead their cases as well.

I hope my items come in excellent condition and I'll forget this unfortunate incident, but if it comes cracked, I'm mad. What can I do?

Just checked my mailbox and it came. A bad feeling hit me though as I opened the envelope. Sure enough, the crack was cracked. No, the hinges are fine and when you open it, it stays together (which is good) but the front of the case, there are two cracks. The instruction manual is fine, as is the disc and memory card. But the front case has two cracks running across it.

What I'm going to do is, email him and let him know. Look, I told you before you sent it to put newspaper over it to protect it, but no you didn't. You waited over a month to send it back and when it does come, it comes in poor condition.

I'll see what his response is and if I sense he is unwilling to cooperate, I will get everyone else he screwed and together we will send the police after his ass. Do not ever deal with him. "Jo Wells". Never.

BTW, if you were in my situation, what would you do? Is a couple cracks on a game case worth overlooking? Remember he also stood you up over a month waiting with excuses. He has screwed 7 other people.

Honestly, I don't think there is that much you could do. He returned your stuff, and suing him over a cracked case isn't at all practical. Maybe if you and the 7 other people all sued him for damages all at once, and they all had big expensice things broken, you might have a chance.

As it stands, you look pretty SOL.

What kind of case is it? Common jewel case, less common U.S. Saturn case, or what?

yeah unless it is some weird proprietary case...just swap it out. If it's a Saturn style case go on ebay and buy a 3 dollar SegaCD game and boom...instant case.

Bio, it's a PSX import case. And I didn't mention this, but it's actually my older brother's game. So... it's pretty bad man.

The game is Fire Pro G Wrestling. The case is uncommonly bigger than a regular jewel case. It has the letters "PSX" across the black tops.

I haven't shown it to my brother yet because he's gonna be pretty f'n pissed. Right now, he's in a good mood, but he'll snap the second I show him it.

It was a stupid move on my part... I admit it. I should never have dealt with Jo Wells.

But that Jo Wells punk made me wait over a month. I warned him 2 different times to wrap up the items in newspaper but he ignored it when he sent it.

I dob't know what to do... but I'll think of something.... man I'll never ever do anything like this again. Shit.

Oh well, life goes on. I'll email Jo right now. See what he proposes.

I know what you are talking about. Those are nice cases. About 1 1/2 times as thick as a regular jewel case?

My friend's store may still have some of their old Japanese PSX Import rental games, which they might be willing to part with for a song. I will see if any are in decent shape.

See, this is the kind of BS I had to put up with for the past 5+ weeks. He *IS* responsible for the case's condition, you can't rely on someone else to wrap it up. All it takes is one minute. Cut out some newspaper, tape it over and place it in the box.

JoNathan is a 17 year old ass and I can't let jerks like him get away with shit like this. Looks like I'll email the 7 other guys and we'll go from there.

Good luck with your case... it'll probably take a while to get anywhere...

I am having an issue that's been going on for over 2 months now with a Master System I bought on EBAY... The 3-d glasses that came with it arrived in a condition not usable as well as everything was dirty and blah blah blah...

I'm going to file an insurance report very soon and from there I SHOULD get all of my money back :D

WTF?!?! EVERY time I send something off to the post office, I *watch* them wrap up the items before they seal the package. That guy is a fucking liar. I think he may have switched one of his old cases for yours, so he at least got a free case out of the deal.

Anyway Steve, off topic but your games have been sent. Hope you enjoy them!

I don't know if thing are done differently over here, but if I send a parcel from the Post Office, I have to package it up, not the guy behind the desk... <img src="graemlins/spock.gif" border="0" alt="[Spock]" />
I wouldn't trust anyone there to do a good enough job anyway, but thats besides the point.

Thanks to everyone who replied with their kind words. It's not so big after I had a night to think about it. But now I will be more aware from this point on. I did so many deals without once being screwed, I forgot you could.

My main concern was basically the reaction of my older brother, but I got this one covered. I'm just glad the game/memory card came back. Maybe one day I'll find a replacement case. My situation is far more fortunate than many others so I can't complain.

Really? I will have to look into that as I need a spare case. Those suckers get cracked so damn easily.

Sometimes if you're sending a game (like I sent the other day), you can just bring them up to them and they'll put them in a priority box (provided you're shipping that way), seal it, and mail it for you after you've paid. I've never asked them to bubble wrap stuff for me though, like that guy said earlier. I don't think they would if you asked them to anyway.
