Seller is not responding from an auction i won and want to know what to do???

Hey guys,

I recently won an ebay auction for a 1999 SNK BURIKI ONE CAGE FIGHTING 25" ARCADE GAME ~NR! and i've got an automated email notification from the guy with instructions on how to pay but.. i've emailed the guy 2 times asking him how he wants me to pay, either cash on pick up or through paypal and have not heard back from him.

I'm freakin out cause obviously i won this at a cheap price and his little policy at the bottom of the auction states:

Item will leave my possession in condition stated in the auction but I CANNOT be held responsible past that. I insure every game for more than purchase price if shipped. Once it leaves my posession I can't help what happens. In other words sold "as-is". Bid with confidence and always check everybody's feedback before bidding, no matter who they are.


I accept Money Orders, Certified Bank Checks and Paypal. Checks wait until they clear. Buyer is expected to make Email contact within 2 days. Payment must be recieved within 10 days from end of auction or item will be re-listed and negative feedback left.

So i'm wondering if he's trying to make it look like i did not contact him by email within the 2 days allowed (even though i have) and forfeit the auction and relist it cause he dont like the sale price.

The man was emailing back and forth hours before the auction end and now i'm not getting any response.

So to the point.. Is there anything i can do to insure i get this from him?

Should i just pay the thing off right now threw paypal and then he has to sell it to me? or will he still just send the money back??

I would pay through Paypal just to cover your ass.

Yeah thats what i'm thinking i have to do. That way it shows that i've made some kind of cantact and payed within the 48 hours he states. He can sit there and say i didnt contact him through email but he cant lie about the payment since i have proof through paypal..

Though, i'm still wondering if he has another way to get out of selling it to me.. Like still never responding to me about pick up times.. then since i have 10 days to get the cab or as he stated before the end of the auction that he wanted me to pay him a deposit for holding the cab up to 10 days since i originally wanted to pay him cash on pickup.

Also i have no phone number.. He has a web site where he does business through and the only info on the contact link is his address.. which i'm happy to have atleast hehe. I'd like the phone number to call him.

I wonder if i'll get that through paypal when i pay him.

Sometimes that info is in the payment screen on paypal I noticed.

PAYPAL him now. You can always do a chargeback if need be for failure to communicate.

Yeah thats what i'm gona do.. though the point is that i'm not worried about getting my money back, i'm only concerned about getting the cab and him not finding a way to back out of the deal cause the price is not to his liking.

Paying him now and will see if i get the phone number or here back from him.

Welp i got the paypal receipt and no freakin phone number or address..

So i guess he prob still can get out of the deal as he just has to continue to ignor me so i wont come and pick it up within the 10 days his policy states. Sure i could show up at his door but who knows if he will answer.

You are in the same state as him...

If he doesn't come through, Sue his ass....... Take him to small claims court....


Under your UCC, a completed auction is a valid buisness contract.

You have accepted his open offer and completed your end of the contract.

He now has to complete his end of the bargain...

Even if i dont pick it up in 10 days of the auction end? I'd pick it up now if he would contact me.

I told my wife that i may have to just show up at his door in the next day or 2 and she's like how can you do that? Dont you have to arrange a time to pick it up with him like the guy did with you when you sold your cab? Yeah, but i think thats his plan.. to not contact me when i can pick it up so i dont pick it up in time.

Hell i may just have to breakin the door open to the damn garage he's storing them in and take it..

Check out his current auction and you'll see it just sittin there right in front saying TAKE ME! heheh.. Anyone want anything else you see?

I bet if someone would email him a question about one of his current cabs for sale, you'll get a quick response back.. but he wont reply to me.

I'll ask him about the Buriki One if it's sold.

OK very interesting response I got.

I said "Is the offer to buy the kit only still good for the Buriki One cab?"

And he responded with:

"Sorry, it's too late, she's already sold and picked up. Sorry man,

Steve"


So I dont know what to think with that response.

Well thats nice.. Nice to see that he will respond to other emails but mine.

Well who knows wtf.. He could of just said that as in its already sold so forgetaboutit.. Or he really sold it to someone and that someone already picked the cab up.

Either way now i'm really ticked cause for some odd reason he's not answering me.. Meaning he might just of sold it off to someone else. Maybe someone came and picked up a cab they bought from him and made an offer for mine and it obviously was a hell of alot more then i won it at and sold it to them.

The part that fuckin blows is that how in the hell do i confront him on the response you got from him? I basicly cant.

Well I sent another email saying that "I found out that my friend won it and he's been trying to contact you for a pick up date as he already paid via paypal."

We'll see if he responds.

This guy could be like a lot of Ebay sellers. They are great at communication prior to the sale but it goes to shit after that. If they don't get the price they want or once they have your money, they really don't give a shit.

Shipping is usually the problem though. You pay for Priority Mail and it takes them two weeks to mail it out.:oh_no:

Anyway...good luck with getting your item.

Now that i think about it.. How in the hell do i prove to paypal that i did not pick the cab up from the guy???? Yeah that thought came to mind a little while ago.

I mean he tells Xian that he sold it and the buyer already paid and picked it up then he could easily tell paypal the same thing.

I emailed him again over an hour ago threw ebay this time and still dont get a response.

He's probably laughin his ass off cause not only did he probably sell it off to some other guy for over double.. prob the 2nd highest bidder but he also got my money as well.

So i'm out the cab and the cash..

EDIT: BTW.. i paid with instant transfer through paypal as i dont have any credit cards anymore.

For Paypal disputes they have to prove delivery. If it is a local pick up it would have to be a signature for pick up and the sort.
