did you buy using a credit card?
if so, just call them and get your money back
dont deal with paypal

or if you bought through paypal with bank account but he didnt have a tracking number, just claim to paypal that he never sent the package

leave some neg feedback too on his feedback score
nobody seems to leave neg feedback when its deserved
